A rental agreement must be signed prior to arrival. There will be a $500 security deposit authorization on the credit card 2 days prior to arrival. This hold is not a charge, but a reservation of funds to cover potential damages. It will be released automatically 2 days after checkout. Side notes: Our pool and lawn need to be maintained every week to keep it enjoyable. They will come through the side gate and maintenance should be brief. ☀️ Occupancy: The maximum occupancy for this property is strictly limited to 16 persons at any given time. Exceeding this limit violates Bay County local licensing codes and is grounds for immediate termination of this agreement and eviction without a refund. ☀️Minimum Age: The primary Guest signing this agreement must be at least 25 years of age and must occupy the property for the entire duration of the stay. The Guest agrees to strictly abide by all Bay County short-term rental ordinances and local regulations: ☀️Quiet Hours: Quiet hours are strictly enforced between 10:00 PM and 8:00 AM. Noise levels must not disrupt neighboring properties. ☀️Trash Disposal: Trash must be placed securely inside the provided outdoor bins. Trash pickup is Monday and Thursday SWIMMING POOL SAFETY & LIABILITY WAIVER (CRITICAL CLAUSE) The property features a private, heated swimming pool. By booking this property, the Guest explicitly acknowledges, understands, and agrees to the following terms regarding pool use: ASSUMPTION OF RISK: The Guest acknowledges that swimming and using a private pool carry inherent risks of serious injury, paralysis, or accidental drowning. The Guest assumes all risks associated with the pool for themselves and all invitees, children, or occupants during their stay. RELEASE OF LIABILITY: The Guest, on behalf of themselves, their heirs, and all occupants, hereby releases, waives, and forever discharges the Owner, the Owner’s LLC, and any property managers or co-hosts from any and all liability, claims, or demands arising out of injury, illness, or death related to the use of the pool or pool deck area. NO LIFEGUARD ON DUTY: There is no lifeguard on duty. All swimming is entirely at the users' own risk. STRICT CHILD SUPERVISION: Children under the age of 18 must be directly supervised by a competent adult at all times when inside the pool area or backyard. NEVER leave a child unattended near water. POOL HEATER & EQUIPMENT RESTRICTIONS: The pool is equipped with a Jandy heat pump and variable speed pump system. Guests are STRICTLY PROHIBITED from touching, adjusting, tampering with, or changing settings on the physical pool equipment, heaters, valves, timers, or automated control systems (including any digital controls or apps). Any unauthorized adjustment to pool equipment will result in a $500 fine plus the cost of any necessary professional pool technician service calls. POOL SAFETY ALARMS & DEVICES: In strict compliance with Florida Statute Chapter 515 (Residential Swimming Pool Safety Act), this home is equipped with mandated pool safety barriers and/or door and window exit alarms. GUESTS MUST NOT TAMPER WITH, UNPLUG, DISABLE, OR BYPASS ANY POOL ALARMS OR SAFETY DEVICES. Disabling a pool safety alarm is a violation of Florida law, creates a critical safety hazard, and will result in immediate lease cancellation and eviction without refund. NO GLASS ON THE POOL DECK: No glass bottles, drinking glasses, or ceramic items are permitted on the pool deck or anywhere near the backyard court/patio area. Broken glass in a pool requires complete draining, vacuuming, and refilling at a cost of thousands of dollars. Guests must use the provided plastic or acrylic drinkware. 4. SMOKING, PETS, & AMENITIES Smoking: This is a strictly 100% non-smoking and non-vaping property. Smoking anywhere indoors will result in an immediate forfeiture of the deposit and a specialized deep-cleaning fee. Property Damage: The Guest agrees to keep the house, furniture, and all outdoor recreation amenities in good repair. Any damage to the property, televisions, or outdoor equipment must be reported immediately to the host. Pets are allowed, only dogs, max of 2. An additional pet fee of $150 per stay will apply. 5. VIOLATIONS AND EVICTION Any breach of this Agreement—including exceeding maximum occupancy, unauthorized pets, noise complaints resulting in law enforcement dispatch, or tampering with pool safety alarms/equipment—shall give the Owner the right to immediately terminate this Agreement, deactivate guest door codes, and evict the Guest without a refund of any remaining rental balances or deposits.
